오바마의 대북제재 행정명령 (Obama's New Executive Order)


Obama’s New Executive Order
Abstract
 
President Barak Obama issued a new executive order on March 16. This is to impose additional sanctions on North Korean regime for its repeated violations of U.S. law and U.N. resolutions.
 
 
The new executive order is required in order to implement the North Korean Sanctions and Policy Enhancement Act of 2016 and U.N. Resolution 2270.
 
 
This order commendably expands and enhances U.S. ability to punish North Korean violators and third-party entities providing assistance.
 
 
This imposes sectoral sanctions on North Korean transportation, mining, energy, and financial services, though it does not match the U.N. Resolution prohibition of correspondent accounts.
 
 
It also provides explicit authority to target entities engaged in or assisting North Korean violation of human rights, exportation of workers from North Korea, cyberattacks, and censorship by the North Korean government.
 
 
As was the case with all previous executive orders on North Korea, its effectiveness ultimately depends on how strongly it is actually implemented.
 
 
Unfortunately, up to now, the Obama administration has not fully enforced existing U.S. laws and regulations despite having an already impressive array of authorities to impose sanctions.
 
 
So far, the executive order has been underutilized.
 
 
The U.S. had all the authorities and regulations they need to go after North Korea, no new laws were needed, only political will.
 
 
Other North Korean orders issued in 2008, 2010, and 2011, 2015 were each touted as robust measures against Pyongyang.
 
 
However, the U.S. continued to sanction fewer North Korean entities that other countries committing far less egregious actions.
 
 
The Obama administration has still not sanctioned a single North Korean human rights violator two years after the U.N. determined the regime had committed crimes against humanity.
 
 
Although the U.S. has sanctioned by name the presidents of other nations, there is still no inclusion of Kim Jong-un or any of the entities mentioned in the Commission of Inquiry report.
 
 
This is a glaring omission. Overall, the new executive order is a strong step forward.
 
 
But, just as with China’s promises to implement the U.N. resolution, we need to reserve judgement until we see how the Obama administration implement it.
 
 
Unfortunately, both Beijing and Obama have repeatedly failed to live up to their hype.

316, 오바마 대통령은 정권의 반복되는 미국 법률과 유엔 결의 위반에 대한 추가제재를 위해 새 행정명령을 발표했다.
 
 
이 명령은 금지된 정권의 행위를 퇴치하기 위해 추가 권한을 행정부에 부여한 이후의 강력한 조처이다.
 
 
이 새로운 행정명령은 2016년 정책 시행법과 유엔 결의 2270의 시행을 위해 필요한 것이다.
 
 
그리고 정권의 위반자와 지원하는 제3()의 실체를 처벌하는 미국의 능력을 기특하게도 확대하고 강화하게 된다.
 
 
이 명령은 정권 제재를 뛰어 넘는 것으로, 2016년 정책 시행법과 유엔 결의 2270정권의 운송, 채광, 에너지 및 금융 서비스의 부문별 제재를 가하지만, 유엔 결의의 대리 계좌 금지와는 일치하지 않는다.
 
 
이 행정명령은 정권의 인권 유린과 노동자 (노예 노동자)수출, 사이버 공격, 검열제도와 관련되거나 이를 지원한 실체를 대상으로 명시적 권한도 부여하고 있다.
 
 
하지만 법문 (法文)은 인상적이고 그 힘은 험악하게 들리지만, 이전의 대북제재 행정명령의 경우처럼, 이 명령의 효과는 결국 얼마나 강력하게 실제로 실천하느냐에 달렸다.
 
 
불행하게도, 현재까지, 오바마 행정부는 제재를 가할 막강한 힘을 가졌음에도 기존 미국 법률과 규정을 충분히 집행하지 않았다.
 
 
예를 들면, 지난 1월의 행정명령 13687정권의 일부라는 이유만으로도 정권의 실체에 제재를 가할 권한을 부여했다.
 
 
이제 더 이상 위법 행위를 입증할 필요가 없게 되었다.
 
 
그리고 민감한 정보나 정보 출처 및 방법의 누설 위험 때문에 특정 실체 제재에 대한 이전의 제약 요인도 제거했다.
 
 
미국은 러시아의 크림 공화국 침입 후 16 명의 러시아 관리의 제재를 위해 유사 기관을 동원했다. 그러나 그 행정명령은 충분히 활용되지 않았다.
 
 
미국 행정부는 정권을 제재할 모든 권한과 규정을 갖고 있으며, 더 이상 새로운 법은 필요하지 않다. 중요한 것은 정치적 의지만 필요할 뿐이다.
 
 
작년의 행정명령과 마찬가지로 2008, 2010, 그리고 2011년의 대북제재 명령들은 모두 강력한 조처라고 선전했었다.
 
 
그러나 미국 행정부는 계속해서 훨씬 덜 엉뚱한 행동을 범한 나라들보다 소수의 정권 실체만을 제재하고 있다.
 
 
그렇긴 하지만, 새로운 제재 목록은 포함된 것뿐만 아니라, 포함되지 않은 내용 때문에 매우 중요하다.
 
 
권한의 확대에도 불구하고, 목록에는 인권 유린, 사이버 및 검열제도와 관련된 단일 실체는 수록되지 않았다.
 
 
오바마 행정부는 정권이 인류에 대한 범죄를 저질렀다는 유엔의 결정이 나온 후 2년이 지나도 여전히 한 명의 정권의 인권 위반자도 제재하지 않고 있다.
 
 
미국은 다른 나라 (벨로루시, 짐바브웨)의 대통령을 지목하여 제재하였으나, 심사 위원회 보고서에 언급된 정권의 어떤 실체나 김 정은을 아직도 포함시키지 않고 있다. 이것은 명백한 부작위 (不作爲)이다.
 
 
미국은 금지된 정권의 활동을 촉진하는 중국의 실체를 목표로 삼는 것을 주저하고 있다.
 
 
중국 내 실체를 포함한 비 정권 실체에만 부차적 제재를 적용하면 미국이 겨냥한 재정적 수단은 완전히 효율적이 될 것이다.
 
 
전반적으로, 새 행정명령은 강력한 진전이다.
 
 
그러나 단지 유엔 결의의 실천을 위한 중국의 약속과 함께 오바마 행정부의 가시적 실천을 볼 때까지 우리의 판단을 유보할 필요가 있다.
 
 
불행하게도, 베이징과 오바마 행정부는 그들의 과대 선전을 실현하는데 계속해서 실패해왔기 때문이다.

It’s Time to Terminate the North Korea Question
Abstract
 
 
Pyongyang’s recent nuclear and missile tests have certainly shocked the world and triggered series of stern responses.
 
 
President Park Geun-hye stood up to Chinese pressure and economic blackmail, by pulling the plug on the inter-Korean venture at Kaesong and moving forward to improve the country’s defenses by deploying what is commonly referred to as THAAD.
 
 
President Park’s agreement with Japan on comfort women in December and decisions on THAAD and Kaesong were decisive, bold and simply the right thing to do.
 
 
And what dialogue? North Korea rebuffed and derailed numerous attempts at engagement, killed and mimed Korean soldiers, threatened Seoul and insulted President Park with the most vile, sexist diatribes.
 
 
The U.S. Congress, frustrated by the timid incrementalism of the Obama Administration, overwhelmingly approved the North Korea Sanctions and Policy Enhancement Act.
 
 
The legislation closes loopholes, adds measures and strengthens potential responses.
 
 
But Congressional insistence in some sections of the text to make enforcement of U.S. laws mandatory rather than discretionary is revealing and damning of Obama’s approach.
 
 
While implementing new sanctions measures is important, fully implementing and enforcing already existing far-reaching measures is as important, if not more critical.
 
 
President Obama has been hitting the snooze bar on North Korean sanctions. For years, the Obama Administration has vowed that it is contemplating additional sanctions but did little.
 
 
By pulling legal punches but always promising to be tougher the next time, Washington squandered the opportunity to more effectively impede progress on Pyongyang’s nuclear and missile programs and coerce compliance with U.N. resolutions.
 
 
U.S. Ambassador to the UN Samantha Power declared in December that someday North Korea will face justice for its human rights violations that the UN assessed were crimes against humanity.
 
 
That day could be today. The White House has the authority to sanction any North Korean official or entity for simply being part of the North Korean government.
 
 
There will be little change until North Korea feels pain. Washington should no longer hold some sanctions in abeyance, to be rolled out after the next North Korean violation or provocation.

김 정은 집단의 최근 핵 및 탄도탄 시험은 국제사회에 큰 충격을 준 안중무인의 미치광이 행위 그 자체다.
 
 
유엔 회원국이 유엔 헌장에 의한 안보리 결의와 유엔의 규범을 무시하고 도전하는 이 부랑아의 작태는 한탄하기에도 안타가운 비극이다.
 
 
이 상황에서 박 근혜 정부는 중국의 압력과 경제적 협박에 대하여 개성공단을 폐쇄하고 한, 미 사드 (THAAD) 논의 돌입으로 맞섰다.
 
 
작년 12, 일본과의 현안의 일본군 위안부 문제의 합의로 그 동안 지지부진하던 한, 일 안보 협력의 새 기틀을 다지게 된 것도 모두 바르고 잘한 일이다.
 
 
중국은 정권의 도발 때 마다 응징엔 소극적이고 대화만을 구두선처럼 되뇌지만, 정권은 여태껏 많은 대화의 시도에도 거부와 무시로 일관해 왔다.
 
 
그뿐 아니라, 평양은 지뢰 매설로 우리 군인들을 중상 입혔고, 한국에 대한 갖은 협박과 박 근혜 대통령에 대한 비열한 인신공격도 서슴지 않는다.
 
 
오바마 행정부의 소심한 점진주의에 실망한 미국 의회는 대북 제재와 정책 강화 법률을 압도적으로 승인했다.
 
 
법률은 허점을 막았고, 추가적인 대책과 잠재적인 대응을 강화했다.
 
 
그러나 미국 법의 시행 의무를 위한 본문의 일부 부분의 의회의 주장은 오바마의 자유재량보다 방법을 누르는 것으로 나타나고 있다.
 
 
평양에 대한 이번의 새로운 제재 조처의 시행은 중요함과 동시에, 이제까지의 현존하는 광범위한 조처의 시행과 구현은 더 중요하다.
 
 
오바마 대통령은 대북 제재에 우유부단했다. 수년간, 오바마 행정부는 추가 제재를 고려한다고 다짐하면서도 거의 하지 않았다.
 
 
미국 법의 강한 펀치를 배제하면서 늘 다음에더 강력하게 제재하겠다고 약속하곤 했다.
 
 
또한 워싱턴은 정권의 핵 및 유도탄 프로그램을 효과적으로 방해하고 유엔 결의를 강압적으로 준수케 할 기회를 무익하게 했다.
 
 
국제사회의 집단적 손가락 흔들기와 항상 다음번 더 강력하게 한다는 약속은 정권의 핵무기와 투발 수단의 개발과 개선의 추가적인 시간만을 허용했다.
 
 
평양은 자신의 전략적 인내 정책이 미국의 정책보다 오래 버틸 수 있다고 확신하고 있다.
 
 
유엔 미국 대사 사만다 파워는 지난 12정권은 언젠가 유엔이 평가한 인류에 대한 범죄인 인권 침해에 대한 재판을 받게 될 것이라고 선언했다.
 
 
그 날이 오늘이 될 수 있다. 백악관은 정권의 그 어떤 관료나 단지 정권의 일부의 독립체라도 제재할 권한을 갖고 있다.
 
 
미국은 인권 침해를 범한 벨라루스와 짐바브웨에 대하여서는 그들 나라의 대통령의 이름으로 제재를 가했다.
 
 
하지만 현재까지, 오바마 행정부는 정권의 실체에는 아무런 인권 침해 제재를 가하지 않고 있다.
 
 
워싱턴은 더 이상 제재를 유보해서는 안 된다. 정권의 다음의 위반이나 도발엔 과감히 조처해야한다.
 
 
정권이 고통을 느껴야 비로소 변화가 있을 것이다.
 
 
중국은 평양의 행동 결과와 자신의 의사 방해에 대한 우려를 느낀다.
 
 
미국은 법과 결의 위반뿐만 아니라, 정권의 금지된 프로그램과 불법 활동을 조장한 자들에 대한 위험 부담을 늘림으로써 정권의 선택을 선명하게 할 필요가 있다.
